What are the Alcohol Laws for Utah?

In Utah, the legal age for alcohol consumption is 21 years old. Our state has a strict ‘No Tolerance’ policy for underage drinking, and even enforces the separation of underage individuals from events with alcoholic beverages. For example, if you are hosting an event at a bar or wedding venue with an alcohol permit, no minors are allowed to be present.

 

Do I Need a Liquor License?

 

To serve alcohol at events or weddings, you do not need a Utah liquor license. However, there are exceptions. If you plan on hosting an event with a cash bar, open bar, or hosted bar, you will need to hold your event at a restaurant, bar, country club, or venue that already has a permanent liquor license. If your event is “private”, meaning that the general public is not invited to your event, you are not required to have a Single Event Permit. A “private” event cannot be advertised on social media, as it will be construed as public.

 

What is a Single Event Permit in Utah?

 

As constituted by the Department of Alcoholic Beverage Control, a single event permit is required if you plan on benefiting from the proceeds of the sale of alcohols in anyway. Whether it may be direct sales or indirect sales. Direct sales of alcoholic beverages include cash bars where beverages are served to attendees who pay for alcoholic beverages as they are ordered and received. Indirect sales of alcoholic beverages include situations where the purchase or payment of entrance entitles the attendee to alcoholic beverages included with the event such as a hosted bar, open bar, and even a wine with dinner.

 

Do I Need a Bartender For my Event in Utah?           

 

In Utah, the provider or host of an event where alcohol is served can be held responsible for any harm caused by an intoxicated guest. To ensure safety to your guests and yourself, it is important that you make sure the consumption of alcohol is done responsibly and legally. Having a bartender doesn’t just make your event more elegant, but it makes certain that your event is being conducted safely. Hiring a certified professional bartender is the best route as they are not only covered by liquor liability insurance, and can check for IDs, but they can responsibly pour drinks and verify safe alcohol consumption.

 

What are the 2024 Liquor Law Updates in Utah?

 

Although there have not been any changes to Utah liquor laws in 2024, new legislation was put in place last year to loosen legislature. In 2023, Utah Legislature made it legal for restaurants to let customers carry their own drinks from the bar to the dining area. A law that was strictly in place to prevent patrons from handling their own beverages.

 

With new Utah residents on the rise and changing demographics, we may see a rise in liquor licenses, but also a rise in rules enforced to these licenses. Currently, Utah’s limited quota of one bar per 10,200 residents is in stark contrast to some states with quotas as low as one bar per 5,000 residents. Some Utah representatives are looking to decrease this quota, but that comes at a cost. With regulations such as “Place of last drink” being proposed in legislature. Which would put establishments under fire if their patrons frequently were arrested for violations such as DUI or accidents involving alcohol.

Avoidance Tip: Familiarize yourself with Utah’s regulations on private events and secure the appropriate permits well in advance. The application process can take time, so plan accordingly.

Common Mistake: Ignoring the specific hours and amounts in which alcohol can be served.

Avoidance Tip: Review and communicate the designated hours for alcohol service is Utah. As noted on the DABS website, alcoholic beverages may be served on any day from 10:00 a.m. until 1:00 a.m. and each guest is only allowed one drink with 1.5 ounces of spirit at a time.
